Is Your Auto Insurer Denying Your Uninsured Motorist Coverage in WV?

General liability coverage is written to protect you and your riders. However, it is important to note that this type of coverage does not compensate you and/or your riders if injured by another driver. In West Virginia, uninsured motorist coverage (UM) in the minimum policy limit of $10,000 for property damage and $20,000/$40,000 for bodily injury is required by law and provides protection if another driver’s wrongdoing or negligence results in losses for occupants of your vehicle. This amount may barely cover the cost of emergency room treatment for a minor accident. Your UM coverage may provide up to $50,000 for property damage and $100,000/$300,000 for bodily injury. If your insurer is denying coverage that you are rightfully entitled to claim, contact Angotti & Straface. We work to protect the interests of our injured clients.

Legal Claims for Underinsured Motorist Coverage

Underinsured motorist coverage (UIM) is optional, and the policy limits for minimum coverage may be negligible. Notably, UIM coverage is calculated by subtracting the amount paid by the at-fault driver from the limits of your own UIM coverage. This coverage is written to cover additional losses beyond the policy limits of a driver who possessed the minimum legal requirements for auto insurance coverage, but whose limits were insufficient to cover your losses. If your UIM policy is at or below that of the underinsured driver, your company may not compensate you. If you have not specifically waived UIM coverage, you may have a claim (whether or not you opted to purchase coverage). Our law firm can help you understand your automobile insurance coverage to help ensure that you and your family are adequately protected.
